Episode 16: What is a Batson Challenge, and who makes them?

How do juries really get chosen? In this episode, our dynamic duo takes on the world of jury exclusion, discussing how and why some jurors are taken out of a jury pool and excused for cause and how others are removed for no good reason at all. In particular, we take a look at the little known use of Batson Challenges during jury questioning, through which an attorney can challenge the exclusion of a jury member. These challenges go to the heart of the Equal Protection Clause of the 14th Amendment, because they claim that a jury member is being excluded only on the basis of discrimination.
Join our legal team for the real world application of when and how to make a Batson challenge and what it actually looks like in a courtroom.
